How Do I Get My Property Back After Arrest in New York City?
Getting your stuff back after an arrest is not always as simple as asking for it back. One of the biggest questions that first has to be asked is: WHY WAS THE PROPERTY TAKEN?
If your property was taken for SAFEKEEPING:
The owner of the property(or his or her representative – requires notarized letter):
- must go to the borough property clerk office (Don’t wait a long time)
- must have valid state issued identification (ID)
- must have an “invoice number”
If your property was taken as Arrest Evidence:
The owner of the property(or his or her representative – requires notarized letter):
- must go to the borough property clerk office no later than 120 days after the termination of the criminal proceedings
- must have valid state issued identification (ID)
- must have an “invoice number”
- must have a District Attorney’s Release or a supervising District Attorney’s statement refusing to grant a release
If the property is not claimed or demanded before the 120 day period is up, the property may be disposed of by the Police Department Property Clerk.
