In Maricopa Superior Court, persons arrested appear in an Initial Appearance Court (IA).  This includes new charges warrants, felonies, and misdemeanors.  These hearings take place at the

4th Avenue Jail

Hearings are supposed to take place at the IA within 24 hours of arrest.  When people are arrested, they are booked into the Maricopa County Sheriff’s Office (MCSO) Jail Management System (JMS).  The Court docket/calendar is updated in three hour intervals 24 hours a day, seven days a week. Usually a Court docket has 40 people but this number can be increased if necessary.  For instance, if there is a high volume of arrests, the docket may contain more than 40 names to ensure that the persons arrested are seen in the target 24 hour period.  IA also hears warrants and handles warrant matters.

Not all persons are arrested and appear in IA.  Some people get an Initial Appearance Summons.  Instead of being arrested and arraigned in IA, these people get an Initial Appearance Summons that will have the time and date they must appear for a hearing.  In these situations, on the date of the hearing, the charges are read, a plea is entered (for example: NOT GUILTY) and a decision about whether to assign a lawyer is made (in cases where one can not afford a lawyer).  The next Court date is also issued.

To Pay a Bond or Fine:

Bonds and fines may be paid at the Fourth Avenue Jail Bond & Fine room located on the north side of the building. It may take up to 48 hours for an inmate’s release to be processed.

The Maricopa County Sheriff’s Office suggests that if you have questions, you may call Sheriff’s Information Management Services (SIMS), at 602-876-0322, prior to paying a bond.  You will need the person’s full name, date of birth, and if possible booking number.

Acceptable means of payment are a Cashier’s Check (official check), subject to verification, a U.S. Postal Money Order or a Western Union Money Order, made out to the Maricopa County Sheriff’s Office. NO CASH IS ACCEPTED.

PAYING CRIMINAL FINES IN MARICOPA COUNTY

The Maricopa County Superior Court Criminal Financial Obligations Unit (CFO) processes payments paid on criminal cases into an automated financial system.  Money Orders and Checks are accepted (no cash).  Payment must include the defendant’s full name and complete case number.

CRIMINAL COURT DATE LOOK UP – FIND NEXT COURT DATE IN CRIMINAL COURT

If your case is in Criminal Court (New York Criminal Court, New York District Court, New York Supreme Court), then you need to use the Court’s WEBCRIMS to find your next Court date.   You can also use WEBCRIMS to find free criminal records. By logging into WEBCRIMS as a public user, anyone, whether you are a defendant or an attorney/lawyer, can find someone’s next court date.  You can find information and the next court date for both misdemeanor and felony cases.  The system also gives you information about what court the case is in, the judge on the case, the charges, the defendant’s name and date of birth, the amount of bail that was set in the case, when the case was on last, all dates the case has been on the calendar, and whether or not a plea offer was made by the district attorney.  WEBCRIMS is run by the Unified Court System and is the OFFICIAL Court Date Look Up website!  Please note that often people who are arrested and given a Desk Appearance Ticket (DAT) will often not find their next court date in the WEBCRIMS system.  This is because the DAT is issued by the Police Department and not the Court system directly.

FIND SOMEONE’S BAIL IN A CRIMINAL CASE

If you trying to find out if someone who was arrested has a bail, you can use the Unified Court System WEBCRIMS site to find a bail amount in a particular case.  You can log into WEBCRIMS and look up someone who was arrested (defendant’s) information and find out if the Judge/Court set a bail at the arraignment and often, it will tell you how much that bail is (bail amount).  You can also find out if someone was released on their own recognizance (ROR).

DON’T PANIC! This page will attempt to help you through the next 24 hours.It is a Law Firm web page and can be considered attorney advertising, but will help you whether you hire our firm or anyone else.Your goal right now is to try and bring your loved one home.

Usually, within 24 hours from a person’s arrest, that person will have an arraignment in the criminal court in the county in which he or she was arrested. First the person will probably go to the precinct.If you speak to your loved one, make sure he or she does not give any statements and requests a lawyer, or
states that he or she has a lawyer if such is the case.This is important and can make a HUGE difference later in a case.

After the person is processed at the precinct, the person moves to a Central Booking Unit and eventually to the Courthouse. Before he or she is court ready, he or she will be identified by the ARREST NUMBER.GET THIS NUMBER FROM CENTRAL BOOKING.Once at the Courthouse, the person is eventually processed and once he or she receives a DOCKET NUMBER.The ARREST NUMBER and the DOCKET NUMBER are crucial to tracking the progress of the person’s case.Often, once there is a DOCKET NUMBER, the case is court ready and the person will be arraigned in front of a judge.

CJA INTERVIEW

Don’t go leaving the phone just yet.An agency is going to
interview your loved one and prepare a report that will be considered during the BAIL decision.It Is called CJA.They will interview your loved one and then attempt to confirm the information given.This means they will be calling the number your loved one gives.If possible, make sure you discuss with your loved one who will be called and what number they should call.  MAKE SURE SOMEONE PICKS THAT PHONE UP!

WHAT IS AN ARRAIGNMENT???

An arraignment is when the Court officially takes jurisdiction over a case.Now they have a file, with a DOCKET NUMBER, a
Complaint set forth by the District Attorney and they have your loved one in custody.Everyone comes together in
front of a judge and they formally charge the person with the crime
alleged.A plea is entered at that time (GUILTY/NOT GUILTY).If a NOT GUILTY PLEA is entered, the Court must then decide whether the person charged should stay in jail or be released.The Court sets a BAIL.The Court usually tries to assess flight risk when considering bail.This means, the Court, which does not know your loved one, will have to figure out whether he or she will return to Court.They use lots of factors, including the nature of the charges, the person’s job history and educational background, and
whether or not the person has significant ties to the community.They also take note of who has bothered to come to court on behalf of the person during the arraignment.IT IS THE LAWYER WHO WILL ARGUE THE BAIL APPLICATION.There may be no BAIL. In that case, the person is released on his or her own recognizance (ROR).That means the person can leave and will come back at a later date.If a bail is set, the person will be held until bail is posted.THE REST OF THE CASE WILL BE DEALT WITH AT LATER DATES.THERE WILL NOT BE A TRIAL ON THE DAY OF ARRAIGNMENT.Arraignments usually happen from 9am to 1am – 7 days a week (except Staten Island/Richmond County).

IMMIGRATION ISSUES

If your loved one IS NOT A CITIZEN of the UNITED STATES OF AMERICA, you MUST MAKE SURE THE ATTORNEY KNOWS THIS.This is very important.There are important additional considerations that must be accounted for when NON-CITIZENS are charged with a crime.Please
make sure you bring any immigration issues to the attention of your attorney

THE COURT SET BAIL, NOW WHAT!?

READY SET GO.It happens that quick sometimes.If you
can post bail in the Courtroom (it wont be there but if you can do it RIGHT AWAY) let the attorney handling the arraignment know so that he can inform the
Court.
He or she should know BEFORE the arraignment, not after.This is because if the Court isn’t aware that
bail is about to be posted, the person might be sent to a Borough house/holding facility.You can then post bail at a
number of locations at that point, but your loved one’s release may be delayed.This could happen anyway, but if you have any chance at a more expeditious release, it is doing things in this manner.

THINGS TO KNOW ABOUT WHEN SOMEONE GETS ARRESTED IN NYC

The arraignment clerk’s in each county court have information regarding when a person who has been arrested may see a Judge.  They are very busy.  Often, they not only do the work they have in the office, they also have to answer the phone.  Sometimes there are 1-2 clerks answering the phones for the whole county.  This means that it may be difficult to get through to find out if someone has been arrested, what someone has been charged with, or when the person may see a Judge in Court.  Please be patient.  The arraignment Clerk in each county is the best way to find someone arrested in New York City.  Please remember that the clerk might not have information on someone arrested in New York until that person is transported from the police precinct or put into the computer system.  Sometimes, someone arrested in New York City is not immediately taken to central booking.
